The Common Council met at City Hall in the City of Black River Falls on October 4, 2016 at 6:00 P.M.  Alderpersons Gearing-Lancaster, Ross, Redbird, Colloton Chrest, R. Eddy, Simonis, Olson and Busse were present.  Mayor J. Eddy presided.

It was moved by Alderperson Redbird, seconded by Alderperson Olson to dispense with the reading of the minutes of the September 6, 2016 Common Council meeting and approve as presented.  Motion carried.

CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN
 ORDINANCE NO. 832
A CHARTER ORDINANCE REPEALING AND RECREATING CHARTER ORDINANCE 693 TO APPOINT THE CITY ATTORNEY
    The Common Council of the City of Black River Falls, Jackson County, Wisconsin, does hereby ordain that Charter Ordinance No. 693 of the City of Black River Falls, WI is repealed and recreated as Charter Ordinance 832 as follows:
SECTION I - City attorney.
(a) Appointment. The city attorney shall be appointed on the basis of merit with due regard to education, training, experience and general fitness for the office, by a majority vote of the council. He or she shall be subject to termination by the council, with or without cause. The position may be held by either an individual or a firm.
1. The process for appointing the city attorney shall be the same as the recruitment and hiring of Department Heads, except that the Common Council, as a whole, shall make the final selection for the position, by majority vote.
2. The appropriate individual or firm must have an office in the City of Black River Falls.
(b) Compensation. The salary and other benefits payable to the city attorney shall be established by separate resolution and/or contract.
(c) Duties and powers. The city attorney shall have the following duties and powers:
1. Shall exercise the powers and carry out the duties and responsibilities set forth in the state statutes, the state administrative code and this Code.
2. Shall carry out the directives of the council, the mayor and the city administrator which require legal work.
3. Shall attend the meetings of the common council and all committees, commissions and boards when requested by the chairperson thereof.
4. Shall prosecute all ordinance violations.
(d) Additional contractual obligations. Nothing herein shall preclude or limit the city and the attorney from establishing, by written contract, other employment terms and conditions not inconsistent herewith.

SECTION II – Effective Date. The City Clerk shall properly publish this charter ordinance as required under s. 60.0101, Wis. Stats., and it shall become effective pursuant to s. 60.0101(5). When the ordinance becomes effective, the process to fill the position may begin. The appointed position may not begin any earlier than May 1, 2017, when the term of the elected City Attorney expires.

It was moved by Alderperson Busse, seconded by Alderperson Gearing-Lancaster to approve the lease between the City of Black River Falls and General Engineering Company for office space in City Hall.  Motion carried.

It was moved by Alderperson Redbird, seconded by Alderperson Simonis to approve borrowing $260,000 from the Jackson County Bank at an interest rate of 1.37% for a term of 5-years for FFY2016 Street Department Outlay Expenses.  Motion carried.
